WorkHere connects highly skilled people from around the world that are interested in relocating to New Zealand with employers with skills shortage roles that they’ve been unable to fill from the domestic market.
In addition to having the skills needed by New Zealand employers, candidates are required to demonstrate that they are genuinely interested in moving to New Zealand for career opportunities and that they are willing to relocate within a reasonable timeframe.
Registering with WorkHere requires candidates to create a WorkHere Profile. Candidates are required to provide accurate information including uploading a current CV/resume and they may also be invited to submit a personal video introduction at a later stage.
Candidate Profiles may be shared with Immigration New Zealand for visa reasons or otherwise.
Candidates may be contacted directly by a member of the WorkHere Talent Team about job opportunities in New Zealand that match their skills and experience. In this instance, candidates will be provided with details about the employer and job opportunity and given the option to approve or decline their WorkHere Profile information to be put forward for the role or not.
You can update your WorkHere Profile information at any time by logging into the WorkHere Platform.

APPLICATION OF TERMS
- These Terms apply to your use of the website. By accessing and using the website you agree to these Terms.
- If you do not agree to these Terms, you are not authorised to access and use the website, and you must immediately stop doing so.

DEFINITIONS
In these Terms:
Candidate Profile is the information you provide when you create a candidate profile and populate the various fields including your photo, CV and in some cases a personalised video introduction.
WorkHere Candidates are highly skilled people that have registered with WorkHere and created and completed a WorkHere Profile.
WorkHere Talent Team are HainesAttract or WorkHere New Zealand employees, partners or contracted individuals that have been employed as part of the WorkHere Team.
Loss includes loss of profits, savings, revenue or data, and any other claim, damage, loss, liability and cost, including legal costs on a solicitor and own client basis.
Participating Employers refers to businesses or organisations in New Zealand who are taking part in a WorkHere campaign to fill skills shortage job vacancies.
Personal information means information about an identifiable, living person.
Terms means these terms and conditions titled Website Terms of Use.
Underlying System means any network, system, software, data or material that underlies or is connected to the website.
Login means a unique name and/or password allocated to you to allow you to access certain parts of the website.
We, us or our means WorkHere representatives from HainesAttract also trading as Attract and WorkHere New Zealand.

YOUR OBLIGATIONS
- You must provide true, current and complete information in your dealings with us (including the information you provide when setting up a candidate profile).
- If you are given a Login, you must keep your Login secure and:
- not permit any other person to use your Login, including not disclosing or providing it to any other person; and
- immediately notify us if you become aware of any unauthorised use or disclosure of your Login, by sending an email to communications@looksee.co.nz
- You must:
- not act in a way, or use or introduce anything (including any virus, worm, Trojan horse, timebomb, keystroke logger, spyware or other similar feature) that in any way compromises, or may compromise, the website or any Underlying System, or otherwise attempt to damage or interfere with the website or any Underlying System; and
- access the website via standard web browsers only and not by any other method. Other methods include scraping, deep-linking, harvesting, data mining, use of a robot or spider, automation, or any similar data gathering, extraction or monitoring method.
- indemnify us against all Loss we suffer or incur as a direct or indirect result of your failure to comply with these Terms, including any failure of a person who accesses and uses our Website by using your Login.

We own all proprietary and intellectual property rights in the website (including all information, data, text, graphics, artwork, photographs, logos, icons, sound recordings, videos and look and feel), and the Underlying Systems.

- To the extent permitted by law, we and our licensors have no liability or responsibility to you or any other person for any Loss in connection with:
- the website being unavailable (in whole or in part) or performing slowly;
- any error in, or omission from, any information made available through the website;
- any exposure to viruses or other forms of interference which may damage your computer system or expose you to fraud when you access or use the website. To avoid doubt, you are responsible for ensuring the process by which you access and use the website protects you from this; and

- We make no representation or warranty that the website is appropriate or available for use in all countries or that the content satisfies the laws of all countries. - Except to the extent permitted by law, nothing in these Terms has the effect of contracting out of the New Zealand Consumer Guarantees Act 1993 or any other consumer protection law that cannot be excluded. To the extent our liability cannot be excluded but can be limited, our liability is limited to NZD$1.
- To the maximum extent permitted by law and only to the extent paragraphs 7.1 and 7.2 of these Terms do not apply, our total liability to you under or in connection with these Terms, or in connection with the website, or your access and use of (or inability to access or use) the website, must not exceed NZD$1.

- Without prejudice to any other right or remedy available to us, if we consider that you have breached these Terms or we otherwise consider it appropriate, we may immediately, and without notice, suspend or terminate your access to the Website (or any part of it).
- On suspension or termination, you must immediately cease using the Website and must not attempt to gain further access.

GENERAL
- If we need to contact you, we may do so by email or by posting a notice on the Website. You agree that this satisfies all legal requirements in relation to written communications.
- These Terms, and any dispute relating to these Terms or the Website, are governed by and must be interpreted in accordance with the laws of New Zealand. Each party submits to the non-exclusive jurisdiction of the Courts of New Zealand in relation to any dispute connected with these Terms or the Website.
- For us to waive a right under these Terms, the waiver must be in writing.
- If any part or provision of these Terms is or becomes illegal, unenforceable, or invalid, that part or provision is deemed to be modified to the extent required to remedy the illegality, unenforceability or invalidity. If a modification is not possible, the part or provision must be treated for all purposes as severed from these Terms. The remainder of these Terms will be binding on you.
- These Terms set out everything agreed by the parties relating to your use of the Website and supersede and cancel anything discussed, exchanged or agreed prior to you agreeing to these Terms. The parties have not relied on any representation, warranty or agreement relating to the Website that is not expressly set out in the Terms, and no such representation, warranty or agreement has any effect from the date you agreed to these Terms.

APPLICATION OF TERMS
These Terms apply if you submit a Registration (as defined below). By submitting a Registration, you agree to these Terms. Any terms or conditions you may include in your Registration will have no effect.

CHANGES
- We may change these Terms at any time by posting a notice on the Website. Unless stated otherwise, any change takes effect from the date set out in the notice. You are responsible for ensuring you are familiar with the latest Terms. By submitting an Application or further Application Materials from the date on which the Terms are changed, you agree (or confirm your agreement, as the case may be) to be bound by the changed Terms.

INTERPRETATION
Registration means to submit your personal details electronically on the WorkHere Website www.workhere.co.nz
Registration Materials means all information and materials submitted as part of your Registration.
LS, we, us, or our means LookSee.
LS Partners means HainesAttract (trading as WorkHere New Zealand) and Immigration New Zealand.
Employers means New Zealand based companies and organisations who are participating in WorkHere Campaign(s) because they are interested in hiring talented people from off-shore to work in New Zealand.
Campaign means a recruitment programme as described on the Website that aims to attract highly skilled international talent to fill skills shortage roles in New Zealand.
Immigration NZ means Immigration New Zealand, the New Zealand Government agency that manages immigration to New Zealand.
Objectionable includes being objectionable, defamatory, obscene, harassing, threatening, harmful, or unlawful in any way.
Personal information means information about an identifiable, living person.
Privacy Policy means our privacy and data protection policy at www.workhere.co.nz/privacy-policy
Terms means these terms titled WorkHere Website Terms of Use.
Underlying System means any network, system, software, data or material that underlies or is connected to the Website.
Login means a unique name and/or password allocated to you to allow you to submit and manage your Application and Application Materials.
Website means the internet site at www.workhere.co.nz

INFORMATION ABOUT THE PROGRAM
- Details of WorkHere campaigns, including the registration, application process and selection criteria are set out on the Website. Please review the information on the Website in detail before submitting a Registration.
- You acknowledge that selection to join a WorkHere campaign is competitive and is based on skills matched to the requirements of the employers and is not guaranteed.
- You acknowledge that should you be invited to take part in a campaign that your travel expenses to New Zealand and return to your location of origin, as well as hotel accommodation and all expenses incurred during your trip and your visit to New Zealand are at your own expense. You will not receive any funding from WorkHere or any WorkHere Partner. You are required to bring sufficient funds to cover the cost of your trip for the duration of your stay in New Zealand.
- If you are not a New Zealand resident or citizen, you acknowledge that you will not be eligible for to visit New Zealand without meeting the requirements of, and obtaining, a Visitor Visa. WorkHere cannot guarantee that you will be issued a visa to enter New Zealand as this is the prerogative of Immigration NZ but can offer assistance with the process if needed.

REGISTRATION
- Registrations must be submitted electronically via the Website www.workhere.co.nz. Registrations will not be accepted in any other way.
- Registrations for specific campaigns must be completed by the campaign registration closing date stated on the Website.
- If you submit your application after the closing date you will not be eligible for the campaign but your details will be retained for future job opportunities in New Zealand.
- You will need to create a user account using your legal name to register. You must create a single user account only.
- You may submit a single Registration only.
- You may be required to provide a video interview submission as part of your Registration. If so, you will be invited to do so and provided with a link to our video interviewing platform.
- We may, at any time, ask you to clarify or provide additional information about any aspect of your Registration. You must endeavour to respond to these requests in a timely manner. We may take your clarifications and additional information into account when evaluating your Registration.
- If your circumstances change materially, with a potential to materially impact your Registration you must advise us immediately. If you decide that you’re no longer interested in moving to New Zealand for work you are required to let us know so that your profile can be removed.
- Additional Registration materials provided by you other than those requested will not be considered as a part of your registration.
- All Registration Materials must be in English.

WITHDRAWING A REGISTRATION
- You may withdraw your WorkHere Registration and delete your user account at any time by logging into the user account you used to create your profile on www.workhere.co.nz and by following the instructions provided.

PROCESSING REGISTRATIONS
- Registered candidate profiles may be viewed and evaluated by the WorkHere Talent Team or participating recruitment partners or employers when being considered as potential matches for skills shortage roles.
- You agree to carry out at least one digital interview as part of your Registration, if we ask you to do so. You acknowledge you are not all registrations will be invited to complete a digital video and that there is no guarantee of being offered an interview.
- You acknowledge and agree that we may undertake due diligence of your Registration as follows:
- We may conduct reference checks, background checks, and online research about you.
- We may directly contact relevant third parties (such as previous employers, business associates, and educational institutions where you have studied and/or worked). You authorise us to collect additional information from any such third party and to use that information as part of our evaluation of your Registration. We undertake not to contact any party without gaining your permission first. We will not contact your current employer unless you give us express permission to do so.
- You must ensure that all referees provided by you to us have agreed to provide a reference to for you.

YOUR OBLIGATIONS
- You are responsible for satisfying yourself as to the requirements of Registering with WorkHere and any specific WorkHere campaigns you subsequently join. You should carefully review the Website, any information referenced in the Website and any other information we provide.
- You must:
- complete and submit your Registration and support Materials yourself, without assistance from any third party (except to the extent this is required due to disability); and
- satisfy yourself as to the correctness and sufficiency of your Registration.
- You must provide true, current and complete information in your dealings with us (including in all Registration Materials). You must let us know if your circumstances change materially, with a potential to impact your Registration including the early acceptance of a job offer.
- All information you provide to us (including in all Application Materials) must be consistent with the information you provide to Immigration NZ.
- You must keep your Login secure and:
- not permit any other person to use your Login, including not disclosing or providing it to any other person; and
- immediately notify us if you become aware of any unauthorised use or disclosure of your Login using our Contact Form
- You must not:
- impersonate another person;
- attempt to influence or provide any form of personal inducement, reward or benefit to any WorkHere or WorkHere Partner personnel;
- act in a way, or use or introduce anything (including any virus, worm, Trojan horse, timebomb, keystroke logger, spyware or other similar feature) that in any way compromises, or may compromise, the Website or any Underlying System, or otherwise attempt to damage or interfere with the Website or any Underlying System;
- attempt to view, access or copy any material or data other than that which you are authorised to access; or
- transmit, input or store anything as part of your Registration, that breaches any third party right (including intellectual property rights and privacy rights) or is Objectionable, incorrect or misleading.
